When Patrick was in Calgary this spring at the resource conference i asked him this exact question about Barrick and the 10% maximum and his reply was that: Barrick could actually have close to 20% of outstanding shares without too much public knowledge. He said they could meet regulations by burying a news release so it would not be picked up very easily.
My guess is that Barrick is already close to that 20% and it would not suprise me if they were behind a lot of the manipulation to get shares from the small retail shareholder. Wes
