2. When Patrick is comfortable he can show everyone tremendous leadership by buying back some or all of the 800,000 shs. he sold at $7.75!! What a great trade as now more than 50% discount.
3. Broker can loan out any or all shares in a margin a/c. It does not matter if there is a sell order pending. If the shares are loaned out & the client then sells them, it becomes the brokers problem. The broker can ask for them back & after a short time if they are not returned the broker can issue a buy-in which is usually a cash trade. This is part of the mechanics of how a "short squeeze" develops
