Un total de 2’082.024,96 hectáreas regresaron a manos del Estado, tras la aplicación de los artículos 2 y 6 del mandato minero, aprobado por la Asamblea Nacional Constituyente el 18 de abril pasado. A total of 2'082 .024,96 hectares returned to state hands, following the implementation of Articles 2 and 6 of mining mandate, approved by the National Constituent Assembly on 18 April.
La cantidad revertida equivale al 46% de la superficie que, hasta antes de esa decisión, había sido cedida para la actividad minera. The amount reversed equivalent to 46% of the area which, until earlier this ruling, had been transferred to mining activity. Más de 992.000 hectáreas que pasaron a poder estatal estuvieron en manos de las diez mayores concesionarias, de las cuales, al menos ocho tienen capital canadiense. More than 992,000 hectares that were passed to state power in the hands of the ten largest dealerships, of which at least eight are Canadian capital.
El artículo 2 dispone “declarar la extinción sin compensación económica alguna a todas las concesiones que, en la fase de exploración, no hayan invertido hasta el 31 de diciembre de 2007”. Article 2 states "declare the extinction without any financial compensation to all the concessions in the exploration phase, have not invested until December 31, 2007."
Igual suerte correrán aquellas que no cuentan con estudios de impacto ambiental, ni realizaron la consulta previa a las comunidades. The same fate those who have no environmental impact studies, nor conducted consultation with the communities.
El artículo 6, en cambio, declara “la moratoria (suspensión) al otorgamiento de nuevas concesiones (...) y el archivo de nuevos trámites de concesión”. Pero en este caso, el Gobierno devolverá el dinero que las compañías han gastado en sus trámites; en total, $ 1,18 millones.
