"well we know that Sylvia was referencing the latest version as this is the first time we've heard that open pit mining is accepted and a max 5% royalty (before they said it could be up to 6%)
it would be interesting to see if this versin references that clause (open pit mining)
also, any version will be titled 'a draft' until it is passed into law

The draft mining law published in May actually references a maximum royalty of 5%:
Definición de Regalía Minera.- Pago al Estado por la explotación de los recursos minerales. Se paga en base al valor del mineral procesado. Rangos de pago - De 1 @ US $ 50 millones/año paga 3% - Entre US $ 50 – 100 millones paga 4% - Mas de 100 millones paga 5% ** Los pequeños productores mineros y mineros artesanales no pagan
The draft mining law published in May also references the clause regarding open pit mining referenced in Sylvia's article:
Art. ..Permiso de explotación.- Cuando las labores mineras a las que se refiere el literal c) del Art. 18 de la presente Ley, requieran un sistema de explotación a cielo abierto, el titular minero, como condición habilitante y previo al inicio de sus labores, deberá solicitar por escrito la intervención del Ministerio de Minas y Petróleos en la negociación justa de compra tierras en los casos que el contratista no haya tenido éxito en la compra de los terrenos que serán utilizados para la explotación.
