To all members of the Agoracom Aurelian Forum.
I have been selected by the Legal Committee to update you on our progress to date. We appreciate your patience, since we have had some difficulty finding a law firm which did not recuse itself from this issue due to conflict of interest. We have now chosen a firm with experience and a history of success in similar actions and have made a written presentation to them of all the pertinent facts surrounding the Kinross Offer. At this time we have chosen to concentrate our efforts onto 3 areas. We seek a legal opinion on;
The private Placement to Kinross prior to the Offer
The Options granted prior to the Offer
The timing, completeness, universaliity, and interpetation of drill results released (or not) by the BOD of ARU
After our first submission to the lawyers we have been told that some of our concerns over the Kinross Offer and the events surrounding this Offer do have merit. Therfore we have sheduled a second meeting early next week to further explore our options. In order to proceed we know that we will be asked at this meeting to provide a retainer. So the time has come for all of us to pony up if we want to carry this further.
My suggestion as to how fundraising might work is as follows and may not reflect the views of the rest of the Legal Committee. We need input from the whole board on this.
I suggest that a Fundraising Committee be selected which is separate and independant of the Legal Committee. They can establish a Paypal account and PO Box in order to receive donations. Donations should be based on the number of shares owned. If we were to assume that the shares on offer above $20 represent 50% of what this board owns, then a contribution of 1/2 of a penny per share would result in a war chest of $20,000. This of course seems too much so I would say that those with 1000 shares or less would not be asked to contribute and that the contribution be capped at $100 (20,000 share equivalent). After all we wouldn't want to make it too expensive for Kieth Barron to join our little group. We could agree that any unspent funds would be donated to the Red Cross or an Ecudorian orphanage or any good cause close to our hearts.
The above represents only a suggestion and all numbers used are imaginary. We hope that we will have a better idea of the funding costs of our legal efforts by next week.
IN CONCLUSION
So shipmates, we are at a turning point for our ragtag crew of anonymous posters and each of us needs to reflect soberly on how far we are personally willing to take this fight. I believe the time has come for us to come out from behind our aliases and avatars, to prove and consolidate our share ownership into one voting block, and to fund our common goals.
