Good afternoon, Crew. I was at a meeting downtown this afternoon and had an opportunity to speak with a lawyer about the implications of Kinross not hitting 90%.
She advised that failure to obtain the 90% by September 15 would then require Kinross to go through a very expensive and complicated "2 Step" process to acquire complete control of Aurelian.
Furthermore, the lawyer went on to add that it so long and complicated "they probably would not want to go through the process".
This isn't over by a long shot. The Aurelian AGORACOM Community has put a serious dent in the plans of Kinross (and Aurelian Board).
September 15th is the new battle ground.

Kerrisdale, I hate to remind you, but Burt did not lie. As George pointed out, it is a very expensive and complicated "2 Step" process, but it can be done.
On BNN today, Tye did not say he wanted to go that route however, because the only one having to pay big time is Kinross (lawyers, court fees etc. and in the meantime keeping everyone at Aurelian on the payroll)
The only people that stand to lose a lot of money are the ones you tried to scare today by saying it will happen, Tye. Well, so ... we are not scared, we have nothing to lose, Tye.
Who is scared here? Who should be scared here?
Time is money, especially in business. Tye does not have the time, nor the resources to wait this out. Ecuador is almost ready to be mined.
We, on the other hand, have nothing to lose by waiting it out. Why make it easy on them. They put us through hell. Let us NOT ever tender our shares voluntarily. Make 'm go through the "2 Step" process and maybe they'll give up after a while, time will tell ;-)
DO NOT TENDER YOUR SHARES.
Why would you at this point? What is in it for us? Absolutely nothing, there is no incentive but also no penalty to hang on.
So again DO NOT TENDER YOUR SHARES.
It is always so much better to do something rather than just give up the fight.
TO ALL THE PEOPLE OUT THERE THAT ARE NOW UNSURE OF WHAT TO DO:
Do nothing, do not tender, you will not lose any money over this, life can only get better. Wait and see.
At some point you may be forced to tender your shares, but so what.
They are still worth the same as they are now and very likely a LOT MORE.
Why not wait it out with the rest of us. We will all sleep better. Anyone concerned how Tye is sleeping tonight?
