Great stuff. Chilbear! If we get some parameters laid down, the way forward should be clearer and we should be able to get a fix on who is ready to take it. Here are some quick thoughts:

IMHO, the damages/failed fiduciary duty case is a lost cause. We needed to go for a temporary injunction ASAP and certainly before the Offer was closed.

In a fair offer hearing, if it can be shown that Kinross colluded to cook up the deal at a giveaway price (and this looks like it might be doable) a judge could be influenced to do better by us than the offer price. Yes, many have folded, but the history on this Forum will show that virtually of those that tendered did not do so because they were overwhelmed by the generous price! Besides that, we might need a couple of breaks, but maybe it's our turn?

I am definitely not trying to paint a rosy picture. But either we look at this closely NOW. or this route too is a dead issue. I see a bit of daylight, but we need to have the opinion of a solicitor experienced in this specific field before we start barking up any tree.

Another option is to examine related case histories ourselves. Problem being, would the group (if such comes forward) have confidence in the conclusions drawn? My feeling is, they would be more comfortable armed with the advice of a paid professional.
