FINRA has been exerting pressure on firms holding large "fails" to deliver the shares. The older the "fails to deliver" the greater the pressure. As a result offshore short funds have been using the technique of establishing a short position in a new account while at the same time buying the shares in the account with the large short position. This is the primary reason for the negative price action and huge volume in CGNH. At this point during the first quarter 32 million shares have traded, close to a 100 percent turnover of the floating supply...For shareholders of CardioGenics the positive aspect of the "shorts" utilizing this technique is that the average price of their short position has decreased from over a dollar to under 5 cents.
