It's likely fake when it suddenly gets move as the bid rises. i.e. as it did from $1.35 to $1.40 and back to $1.35 again when the bid droped. This signifies that the seller doesn't really want to sell.

It's also works as a tactic to accumulate shares at a price slightly lower than the big ask. i.e. The seller puts up a wall at $1.35 and anyone else who wants to sell now is basically forced to put in an order below that to get their order filled; in turn keeping the SP down.
