And what if CUU doesn't release the BFS, and just announces a buyout?

in order for this to happen...one would have to assume/or say that TCK has seen the BFS?? it would seem so.....how else would this be determined if otherwise..... Have we not been told that we will see the BFS? Perhaps this is where the NDA would come into play....is this correct.....Thank you!!
