RT is right, Skeeter Lake will be no more if the preferred tailings option is implemented. It is more of a glorified swamp and yes, not fish bearing. The whole Skeeter valley will be pretty much filled in with tailings with dams on either end. This has been the plan since 2008 PFS and has been slowly going thru the regulatory hoops since then and maybe before.
Since it isn't fish none of that stuff applies. There might be toads but they are easy to move into new homes. That leaves the Navigable Waters Protection Act and the (ministry) Transport Canada to decide on its status as "navigable water" and decide if it is of value in that regard. It is a bigger hoop to jump thru since under the old NWPA an Order in Council is required in Ottawa for the approval to fill it in. With Harper and his Conservative majority (read right of center+) and the benign nature of Skeeter pond this should just be a procedure more than anything.
