They can legally acquire cuu shares as long as it is disclosed.

It seems a bit odd that they could start buying Copper Fox shares until it hits a price below which they would be willing to buy it out anyway. Maybe in practical terms it is not an issue because it would go up too high too fast once they started reporting.
