Hello golf. One small point in response to your post. Hector and his firm may be precluded from acting as counsel for the company if there is any potential that he may be a witness in the litigation. It is considered inappropriate to appear as both counsel and witness in a matter before the court and the admonition extends to other lawyers in one's firm. Thus, if Hector is a witness, his law partners and staff lawyers would be subject to the same admonition.
