QUESTION: Is our present "wait" tied to completion of the draft of the "New Mining Bill" as stated by the Head of DGPEM a subsidiary of our "partner" MIBAM. Note the use of the word "feels" in the quote of Mr. Medina. Are we to believe that this is simply his opinion? If this is only the opinion of another bureaucrat preening himself on the public stage, then we need to ask ourselves who is the dog and who is the tail. I hope that MIBAM is the dog and DGPEM is the tail and that Mr. Medina is not voicing the opinion of the dog....otherwise we could be in for a long, long wait with a kick in the balls as a possible reward for our patience. I still cannot fathom why MIBAM, as our partner, has not been more forceful in publically dismissing fears created by this type of comment. One thing we do know....we know that we've been delayed and we don't know what the holdup is. Well guess what...with the information available to us I have to put "passage of the New Mining Law" at the top of the list of reasons for the delay. Perhaps someone on the board has a better reason (substantiated by fact) for the delay. If so, I'm all ears. Questions for RM...Who is the tail and who is the dog...DGPEM\MIBAM? Has our partner (MIBAM) clarified this statement at all? Will they clarify it if asked? If not...why not?

Venezuela's general authority on mining economy and planning (DGPEM) - part of the country's basic industries and mining ministry (Mibam) - feels the new law to regulate the sector will determine the eventual consolidation of the Las Cristinas and Las Brisas gold projects.

"There has been talk of combining the projects because of the deposits' geological characteristics, which are uniform. We have to wait to see how the criteria is drawn up and see if it can be done," DGPEM head Javier Medina told BNamericas.

4. We've been hearing about the "New Mining Law" now for longer than I care to remember. I thought I read somewhere recently that it should be "done and dusted" by the end of this year. Although KRY has an operating contract and Venezuela owns the gold....we've been hearing that the "new model" will be 50-50 joint venture. Do you anticipate having to wait for the "New Mining Law" to be finalized before finding out what the fate of KRY will be? When Phillip Cottin was asked a year or so ago what KRY's plan would be if they were forced into a 50-50 joint venture, he said that "there was no Plan B". Has KRY developed a "Plan B"? If not, why not? I have been involved with the Company since the early 1990's and have been reading and hearing of a new/revised mining law just around the corner. I believe modifications were considered and enacted in 1999/2000 with little impact on foreign investment and plans. In 2006 the MinAmb circulated another draft amendment proposal that was viewed as benign to the existing industry. The draft got little traction from the Government and fell off the agenda. I see again the chatter has resurfaced but to date no drafts have been presented. If/when a draft is presented then we'll be in position (after review) to comment on it. Until then it would be pure speculation by anyone.
Crystallex has a Mine Operating Contract, awarded by the Chavez Administration, that is in full force and good standing. The MOC has been reviewed and audited by numerous government agencies and we have confidence in the Contract and laws that govern it.
