Sorry for bringing Yahoo stuff here but it pertains very much to the class action suit. From Nikko aka Dan Russo:

"the class action lawsuit will be paid out of insurance proceeds. a decision had to be made to protect my interests. still believe the permit will be issued. the suit has nothing to do with that from happening. i have plenty of information which i amn willing to share."

I might add this was an earlier post today by the same person who brought the suit on:
