By Executive Decree number 6603, dated December 29, 2008, published in the Official Gazette of the Bolivarian Republic of Venezuela number 39-090, dated 02 January 2009, has been extended irremovability labor decreed for workers, public sector and private sector from January 01 until December 31, 2009.

Thus, the workers covered by the aforementioned decree of labor immobility, can not be dismissed, deteriorated, or transferred, without just cause previously described by the Labor Inspector its jurisdiction, according to the procedure laid down by Article 453 of the Organic Law Labor.

Failure by the employer to irremovability under the decree, entitles the worker to apply for re-payment of salaries and the Labor Inspectorate concerned, in accordance with Article 454 of the Act's mandate for Decree stated, the Labor Inspectors handled preference proceedings arising from the special labor immobility, under exceptional and temporary.

Are only exempted from the extended tenure of work: 1. Workers direction.

2. The workers of confidence;

3. Those with less than three months in the service of an employer.

4. Seasonal workers, casual or occasional.

5. Those who earn a monthly basic salary of more than three (3) current monthly minimum wage, ie Bs.F. 2399.19 (Bs.F. 799.73) to the date of the decree determined.
