If absolutely no progress is made between now and May I don't know how they could avoid arbitration and expect to be taken seriously. I think once you make this type of threat you need to follow through. But if there is some form of progress between now and than maybe they can avoid it. I would think that the arbitration can always be terminated if the permit is issued.
