The National Post reports in its Thursday, Feb. 19, edition that one week back, Justice Peter Cumming of the Ontario Superior Court granted Gold Reserve an interlocutory injunction that prevented would-be buyer Rusoro Mining from proceeding with its hostile offer. The Post's Barry Critchley writes that as a result, the matter is back to square one. One unnamed observer says the two companies should still be put together. "This is yet another example of gold miners spending more time and more shareholder money fighting each other instead of making shareholders money. ... It fully makes sense to consolidate foreign interests in Venezuela." Justice Cumming in his ruling cited the factum prepared by Rusoro, "The real issue in valuing Gold Reserve is not how much ore is in the ground at its property, it is whether the Venezuelan government will allow it to exploit that ore and how long it will take the company to obtain the necessary permissions and build the necessary infrastructure." Law firm, Davies Ward Phillips & Vineberg says the case "serves as a cautionary statement that bidders should ensure the independence of their financial advisors." The firms had the same financial adviser.
