How do you know how much to finance for if you don't know or can't project what your expenses and legal fees will be over the the life of the arbitration?

This is a game of poker. The amount Fung must raise is the amount necessary to bluff the other players into accepting that we have the wherewithall to withstand an arbitration. Once they see this, they will fold and we will get a settlement.
