I don't discount what you say, but keep this in mind:

In Q4 we are out of money and can do nothing. We can't even file for arbitration. So VZ needs only to wait because without money we would not be able to keep to the MOC.

I don't see VZ making any move for a settlement until they see we can get funding to go to arbitration no matter for how much time that will take. I am certain Mr. Fung knows what his expenses would be over a few years so he would need to ensure enough capital.

If we obtain fianancing even for 1 year of arbitration it puts some teeth in our threat so they would likely move to settle.

As to the court document that could damage KRY....who knows what it is but the noteholders have held off so they must at least see some hope for themselves in it.
