Hello Mr. XXXXXXXX. The Hearings for the noteholders' second claim were
held on Thursday and Friday of last week and concluded on Monday of this
week. Both the plaintiff and defendant had the opportunity to present
arguments to the Court. I understand the noteholders' argument continued to
be along the lines of a project change in control. The claim, any next steps
and/or decision now rest with the Judge. The Company maintains that the
noteholder claims are without merit. Should an adverse decision be issued
against the Company, I understand the Company has rights to an Appeal.
