This i s Richard's response to my question:

Hi Rob, in Judge Newbould’s decision in December said that the noteholder’s should be responsible and compensate Crystallex for the costs associated with defending their claim. Counsel tells us that it is rare for a court to agree with all costs and we believe the court will/is reviewing our bills and will issue a number. The costs and defense were significant and if we had too guess, the range could be several hundred thousand to a few million in reimbursement.
