8. Public Announcements
Neither party shall make any public announcement regarding this Agreement or the Transactions contemplated by this Agreement without providing an opportunity to the other party, acting reasonably, to review and comment on such announcement or press release. Recognizing that such public announcements may be required under applicable law, each party agrees to review and comment on any proposed public announcement of the other party as expeditiously as practicable.

This Agreement shall be terminated on the earlier of (i) the date of execution and delivery of the A&F Agreement; and (ii) 5:00 p.m. (Toronto time) on July 31, 2010 or such later date as mutually agreed,
It would be great to have this Agreement signed today, but July 31st is the date set. As well, the agreement can be signed at a later date if both parties agree, without it being terminated.
Why the heck is there so much aynx out there? Sure, were all wanting to see the first real sign that this deal is absolutely for sure a done deal and real, but god all might, this is, as pointed out, a complex document. There is no necessity for the two entities to want to put out a press release telling all of us kids to 'just settle down now, your treats are coming', when we haven't even passed the deadline, which is not really a deadline.
So have an early drink or two, suck it up, because IT IS GOING TO BE SIGNED VERY SOON.
