Venezuela is specifically NOT involved in the efforts of the Primary Agreement, and I believe that is wise. They do come in as the last step before signing a final agreement for a JV.
4. Conditions Precedent to Closing of the Transactions Contemplated by the A&FAgreement
(b)...........Venezuela shall have issued the "Permit to Impact Natural Resources"
Now Venezuela IS in the game, in the bottom of the ninth.
I for one cannot believe that KRY/CRRC, with all the talent and resources available, has not finalized everything necessary for a successful JV Agreement. And timing is not the problem. They can take whatever time they need.
In two places, once re: Shareholders meeting by August 30 2010, and again re: Termination, July 31, 2010, the Agreement states "or at such later date as mutually agreed".
I believe everything that is needed to move forward is in place except.........the Permit. It is like having a shiny new car sitting there waiting for you, and NO KEY!
It is now all about Venezuela, and there is nothing any of us can do about it but wait.
