civi, he may not be far off for the icsid claim part of the expense but this will not include legal fees (the lawyers) and other expenses. i'm guessing he's talking about the "fee" side of the arbitration at 1-2%....below is an arbitrator cost calculator from ICC (arguably cheaper than icsid and shows only the fee/arbitrator cost for a $4bil claim..i would bet the lawyers are the expensive part..it's hard to get a handle on true expenses in an icsid case but based on "awards of costs" in concluded cases and financings from companies involved in cases i'd say $8mil is a total wet dream...
