to all, i've been having a PM discussion with one of our members and think it's a good one for the board. i wont paste the other members responses without permission but here is my last response on the issue. anyone have any thoughts on this?
XXX, on the good side, after reviewing a number of icsid cases the minimum $350mil will be at least doubled due to interest and exchange rate issues. on the bad side, lost profits is far from a "gimme"..the best case would be some type of settlement from ven but i dont think management will look at it the same way. why would management settle for anything when they have nothing invested? they can stretch out salaries for years with arbitration. i think in the end this will get real ugly with regard to mngt, bondholders and shareholders. we desperately need a "white night" and i dont see one at this point. if we see another "option deal" then we know something is on the horizon. fung wont settle or sell out unless he and his cronies get a fat "going away" present imo....
