The primary driver would be the strength of the arbitration case, but true, being delisted from AMEX doesn't help. I would imagine the most important parameter after getting past the strength of the case would be how much management is willing to give of the potential settlement.

Maybe the folks that participated in the bought deal wants another swing at it since their 30 million warrants expire in 30 days.
