The news release says "certain" noteholders, not all of them. It's possible that only a portion of the 100 million is involved in this latest development. Maybe a few of the noteholders will get thier money back(equipment sales or creative financing) and some will wait out the arb case for thiers. If they all sued none would get completely compensated at this stage of the game. Who knows.
