I believe Kry also had most of the work done on the arbitration before filing. It doesn't seem unreasonable that Kry would continue to pursue the permit and keep their MOC in good standing while preparing for the worst.

IMHO our case is much stronger because VZ canceled the contract while we were in complience. Since I'm not privey to all the information management is I have to believe they sincerely thought a solution could be reached avoiding arbitration and if it wasn't their best case was to show they did everything asked of them.

Given all that I'm still pi$$ed that we are in the situation we are in. I unfortunately have no one to blame but myself for ignoring the warning signs and being greedy.
