Okay, let's speculate:
if the icsid award's us half of our demand of $3.6B it is Vz that owes the money but Hugo, the deal maker will not give up the cash but would pass it on to his preferred developer. That would already put the company $1.8B in the hole. I speculate the value of the gold in the ground is $36B but it costs plenty to dig it out. If we get $3.6B the preferred company is really in the hole before even the first shovel.
A company at the starting block with $3.6B in the red has a lot of makeup to do to get that money back. I doubt there would be a company Russia or china that would invest in such a wild deal.
So, what is the solution? if hugo gives the property back to KRY, the arb process is cancelled and hugo does not need to put up any cash. He did some thing similar with the Italian oil company (can't remember the name and too lazy to look it up - it is ENI by the way) although he did have to put up some cash. He claimed with the new deal he will eventually get that cash back. The Italy oil company and hugo are now talking about building a heavy oil refinary complex costing $41B.
I speculate that if chavez dies or is not re-elected the prudent thing for the new government to do is to give the property back to KRY.
My preferred outcome is to continue to arb to the end and get the money due and a BIG pop in the pps. I'll wait the 3 years.
