The question that arises in my mind upon reading his comment is whether a "regulatory" filing is required if the placement is completed. If so, great. If a "regulatory" filing is required for reasons related to failure of the closing, on the other hand, then not so great. Of course, a regulatory filing might be required either way which makes his comment essentially neutral. Anyone know the answer?
