Affidavit claims are the truth as the person sees it. Noteholder demands are only demands - and were tossed by the judge, but did contain ill intent to current shareholders. I suspect this is a negotiation tactic of posturing with implied threat, take no prisoners, etc. - and will be ongoing.

Claims, and demands with ill intent towards shareholders, are very much different than completed actions. Although, am tending to believe the interference. Compushare, like all the large money outfits, is not one to take lightly and has numerous tools, many untraceable. The claims in the affidavit, and the Noteholder demands may be/become reality. Then again, maybe not. The judge is sympathetic, but there is no guarantee this judge will always be the one deciding during CCAA. Be aware that company information to shareholders is the truth - as the company sees it.

Crystallex appears to be using a tactic, quite common with OTC/Pink companies. That is, "deflection of responsibility." There will always be a reason the company was wronged. Lack of updates is another tactic. Keeps us in our seats. There are numerous tactics. It is literally a minefield. In OTC/Pinks, it is all about perception because there are no Big Guys to answer to. Since many here have been in for a very long time as an NYSE/AMEX or TSX holder, the expectations are for reality - real income, real updates, real profits, etc. Hence, the frustrations. Such Pinkie/OTC tactics tend to dupe the NYSE/AMEX/TSX investor. No claim is being made of devious behaviour. However, one should be acutely aware of the red flags that continue to pop up, time and again. A knowledgable investor is a better investor.

What seems to have happened here is Crystallex took a major risk for the huge reward in Venezuela, and stockholders are along for the ride. Crystallex financed themselves to the gills to play out their dream shot, because they truly believed. If successful, they become the greatest heroes on the planet, and money literally falls from the sky. If not, it could be tough finding employment. Company survival. That is the risk-reward here.

Time will tell.
