guys this lost profit talk all sounds good and i know that's what folks want to hear, (and i may sound "negative"...again) but to date this is NOT the case at icsid... sloopskippers post pretty much sums it up.

if you think lost profits are a "gimme" read some of the published concluded awards. it might change in the future with venezuela (maybe the IMF wants to smack them) but so far I hav'nt found a single icsid award that awarded ANY lost profits to a company that did'nt have a black/white history of profits. i've found many awards that rationalized why "lost profits" were not awarded. icsid seems to be generous on the investment/interest and currency exchange side but lost profits are another matter.
