The closing deadline for bidders to submit their bids could be Feb. 23, which is the target date under Key Dates and Deadlines in "CCAA Financing Procedures":
"Loan Closing Deadline— date currently targeted is February 23, 2012."
But not so simple becaue under defined terms, the phrase "Loan Closing Deadline" has an alternate meaning:
"Loan Closing Deadline means the later of (i) February 23, 2012; and (ii) such
date as Crystallex shall determine (in consultation with the Monitor), but in no
event subsequent to the Outside Date."
And surprise, surprise, Outside Date is defined as April 2, 2012:
"Outside Date means April 2, 2012."
So the closing deadline may very well be the last minute possible if history is to repeat itself. As I say, Chinese water torture.
