According to the E &Y rep with whom I spoke last week, the pre-hearing filings were supposed to be filed 10 days before the hearing, which is to give notice to those who may want to appear at the hearing with objections, suggestions, etc. But according to RM on Friday, there was a discussion that very day that the hearing may be held on a different day and not today. This is most likely because the 10 day rule or however the judge modifies it is normally essential for there to be a fair hearing. Even if the pre-hearng materials were filed last Friday, that would not be enough notice absent exigent circumstances. Bottom line: don't expect a hearing to necessarily take place today. No one really expected things to go normally, right? :)
