It is about a week before the hearing. JJ is correct if one fax shows up it will not matter. If 100+ faxes/letters appear from shareholders, the judge will take notice. Will it make a difference - depends on his mood that day.
My suggestion... Shareholders do not provide solutions for whatever deal is cut. That would be ignored and tossed. Management runs the company and always knows what is "best" in the eyes of the court. The big deal to a shareholder is share value. Indicating something like...
According to what has been disclosed of the current deal, Shareholder value will be significantly impacted, while company management and the lenders will benefit considerably at Shareholder expense.
Should be enough to get the judge's thought process working. Hondo is correct, though. Everyone needs to be on the same page. May still be ignored depending on how far this has already run in the back rooms. However, taking a few minutes can't hurt at this point. A cc: to the press can't hurt, either.
