The discussion about Crystallex negotiating with the noteholders and coming up with a plan made me think about what we are really doing.

The noteholders plan is to eliminate everyone and take the arbitration case for themselves. They would have gone through the arbitration process just like we are to receive their money in the end. The court and monitor have seen it for what it is and have said NO!

Crystallex's plan is the same as the noteholders except they want to pay everyone not just the noteholders. They are negotiating and will soon have a mediator to help. It would be amazing to listen to the negotiations.

They can dance around the issue of who gets what but the concept that Crystallex wants to pay everyone and the noteholders want to pay themselves with both sides using the same process has been put to rest by the court.

The noteholders are unsecured creditors who now fall behind Tenor so even if the judge agreed to allow Crystallex to come out of protection and be dissolved the noteholders still wouldn't get the award.
