Crystallex International Corporation is a Canadian-based gold company with a successful record of developing and operating gold mines in Venezuela and elsewhere in South America
That would not be anything of consequence, our attorneys would supply the court with ample information to simply take judicial notice that it is a part of the Venezuelan government.
It is not open to rational dispute and the evidence so overwhelming that any attempt to make that argument would probably lead to sanctions against Venezuela and their attorneys. It would also really piss off a federal judge, and none of them suffer fools lightly.
Moreover, if any attorney makes that argument in a US court related to Crystallex, I will personally report him and his firm to every bar where admitted for disciplinary action based on making that frivolous argument. To make an argument one MUST have a good faith basis, and this argument is beyond ludicrous. Making arguments that lack a good faith basis violates the bar rules in every state.
