The fact that Highbury did not prevail because the panel found no jurisdiction under Article 22 of the Investment Law should be of no concern to Crystallex shareholders. Conoco also lost on the Article 22 jurisdiction agrument. Conoco, however, won the jurisdiction agrument under Article 9 of the BIT between the Netherlands and VZ. And as we all know, there is a very strong BIT between Canada and VZ. Thus we will prevail on the jurisdiction agrument.
