Message: Capital Gains Loss

I want to write off my Crystallex shares as I am selling my home and need a large deduction to offset my capital gains of my home. I feel it would be a no-brainer to do this since we don't know if we'll ever see a reward from KRY, and believe this would basically be a good move to reduce the capital gains taxes incurred on the sale of my home.

Since Crystallex is in arbitration and the company is still in business, but has been deslisted (cannot sell my shares), how do I proceed to report a capital gains loss? I was trying to find this info on the internet, but it states you must "prove" that the stock is worthless if the company is still in business ( but you cannot sell the share). I have ~60K shares that I need to report. Can anyone please advise?
