If you can't convince us that opting in is a bad decision then what should you try.
With your connections can you tell us why Tenor/Kry have not moved the case for recognizing the award forward in the good old USA. If I'm not mistaken it took about 3 months to get Canada to recognise the award for enforcement. April 4th, 2016 we were awarded the money from ICSID and on July 11th, 2016 it was recognised in Canada.
The last monitors report in Dec. 2016 states:
Crystallex has commenced proceedings with respect to recognition and enforcement in the United States (District of Columbia). On July 25, 2016, Crystallex also brought a motion requiring a pre judgement bond to be posted by Venezuela as security for payment of the Award. Both proceedings remain pending.
Do you know of any reason Tenor would be in no rush to see the award enforced in the USA other than it forces VZ to pay up sooner? That would be a good question for Fung in front of a judge don't you think?
