don-wys: I'd like to comment on your hope for "justice". You may know this or find it uninteresting. If so, skip to the last paragraph.
I'll assume you are not looking for metaphysical ("turn the other cheek") justice because this is one of the many secrets of faith; you won't know if you get it, at least not during your life. So you must be hoping for some rationalistic justice - "to give to each his own" type of justice. If you are looking for something beyond the law (a moral "eye for an eye" justice) then you will likely be disappointed. What would this look like? Wouldn't that require Tenor / Fung to be put through the years of pain that you have gone through with this? No, whilst you might like this you are not hoping for this.
So my guess is that you are looking for the law to deliver justice. (A law that you likely had no clue existed until very recently.) This of course is always a fallacy. I can explain this but I suspect you know this to be true. Courts do not dispense justice. Any lawyer saying they are seeking justice is ripping you off. Anyone claiming they are trying to get justice is a snake oil salesman or they drank the kool-aid.
So, which is it don-wys? Are you selling snake oil or did you drink the kool-aid?
(You know I'm being sarcastic, right?)
Despite justice being subjective (and a fallacy), in our case we can actually put a price on justice. What is the price that brings justice for you (it is likely different for everyone)? For me 30 cents / share.
