Fung is prospering more because he managed to arrange a deal prior to any DIPS that he would be part a payment plan that came from the award. Both Tenor and the Bondholders were in agreement and it was part of their court documents with Fung getting paid by who ever won.

I complained at the time that mamagement held shareholders hostage. The concept they wouldn't assist with the ISCID case without getting a percentage stunk. It was managements job to protect shareholders and instead they sold us down the river and made a side deal for themselves.

Fung now gets paid and his percentage is guaranteed by Tenor so no matter what we get he gets paid. This was the first indication I had that Tenor and Fung were going to take all our percent of the award. If Tenor ended up with everything Fung still got paid.

Fung has almost no shares. From memory it was around 20,000 which is less than most of us here.
