Paau, I disagree with your view of option 2. 

Here is my simple question for you to answer. Do you have a copy of the opt in agreement? From what you have said it appears you haven't read the opt in agreement.

Option 3 is basically a class action which the opt in is not. I suppose that doesn't mean the judge can't make a class action out of it.

It appears the point you are trying to make is all shareholder will be paying the legal bills for crystallex and tenor. In a simplist view your are correct assuming shareholders end up getting anything without Gowling and the committee stepping up to sue. I think it is pretty safe to say that if the committee had not stepped up tenor would have kept burning through cash until all shareholders ended up with ZERO.

In my view, no matter what the legal fees are to fight tenor we would get Zero with the fight so we are not losing a dime because of the legal action. The loser is tenor.

Let me give you another example of how suing is our only choice at this point unless Tenor makes a deal.

Let's say you are walking down the street and and a policeman stops you. You decide not to answer his questions thruthfully and become unruly. The policeman arrests you and in the ensuing ride to the station he stops and beats the hell out of you. You decide to sue the city and police for the assult even though you know all taxpayers will be responsible for the award and legal costs of the police and city. How can you be so selfish to cost all taxpayers money for the injustice done to you?

After you win 10 million doallars you are contacted by every other person ever assulted by the police and they ask you to share your award money because it isn't fair that you got money and all they got was more taxes to pay thhe citys and pokices legal bills.

I know it isn't my best work but I'm tired. I also know it is a wste of time since you have decided to side with tenor for reasons only known to you. We can guess but only you know for sure.

You final comment about Gowling and you forming your own ad hock committee is something I would encourage you to do Let us know what firm you get and when we can opt in for free. I look forward to comparing agreements that is assuming you want everyone to opt in with you.
