Sometime further down the road assuming Gowling has 10M shareholders in their nest. At the very last court moment  to end everything  forever, Tenor agrees to give Gowling $100M to remove their lawsuit from the courts. Gowling agrees.

We get $10/s in the closing deal. I would accept that.
