Those of you looking to learn a little more about part of Gowling's case may wish to read about Great Basin Gold and specifically the judgement made by Madam Justice Fitzpatrick in October 2012. She addressed the issue of a DIP loan and the criminal code thoroughly. I'm sure Don and Jimmi will find plenty in that ruling to give them hope. Madam Justice determined that the court should "wait and see". Unfortunately GBG never realised sufficient assets, a property valued at over $1 billion was sold for around $10 million or something like that. Sadly, the DIP lender (not Tenor) lost a lot of money.
