Mayo / Don-wys,

This is a marathon by design, not a 100-meter dash. The strategy here so far has always been to move the finish line time after time to get the dashers exhausted and fallen by the wayside. Remember the criminal interest rate issue and all the contortions used in the credit agreement to avoid it, and the Nomura Notes? Well, letting time pass is the safest approach.

So, you can spend a lot of money on lawyers just waiting to have your day in court. Legal action is effective only when warranted.

Also, you may not know this:

- One may opt to be one's lawyer (pro se) in American and Canadian courts,

- One can get plenty of help from the court itself and legal action groups to pursue your case pro se. This specially if there is a public interest involved, e.g. include everybody involved in the CCAA in the suit (i.e. Bankruptcy Superintendent, Canadian Revenue Service, Canadian Business Corporation Director, the Monitor, E&Y, Tenor, the Board of Directors, Gowling, etc.) to expose the CCAA sham,

- The court may even help you find legal representation or assistance to make sure you have your best shot at your case,

- The Ontario Court of Appeals has a program to help you prepare for your pro se representation. The Delaware District Court and the Southern District Court NY, do the same,

- The court standards for and expectations regarding pro se representation are deferential. Nonetheless, courts prefer pro se representation be assisted by a competent lawyer (hence their willingness to help you find someone to help you).

One can also:

- Hire a lawyer on an hourly basis on as-needed basis,

- Get a law firm to work pro bono. Most reputable firms do this as their contribution to society and supporting the rule of law. It would not hurt to agree with your pro bono firm to include a clause in the representation agreement that allows for charging costs to the defendants, which can be passed on to the firm for their good deed and to help the pro bono cause.

We all have lawyers in our family or social sphere that can point us in the right direction

In summary, there are several options.

Note that options may be limited by whether you are a citizen / resident (i.e. American vs. Canadian). A "local" is vested with rights and opportunities that a non-local may not be afforded.
