The shareholders must be front and center in this case; and must be united and resolute in protecting their rights. No court can protect somebody's rights without the aggrieved person showing up and making pleadings supported by facts that will require it to act based on the law or the equities involved. Without this, the court has no authority to intervene. This is in fact the easiest way for profiteers to make money off small investors: relying on the high cost of legal representation and/or abuse of process to keep them from showing up in court.
We have a whole lot to thank the Constitution's Framers for; with the ethos of our judicial system being at the top of the list. Thanks to the Framers, we are not plagued by mickey mouse courts where the citizens have to pay the piper for somebody else's misdeeds.
