I agree with that logic.

This would reinforce my belief that the number of shares wouldn't be decreased by 40% because of tax loss as suggested by Argo earlier.

It also wouldn't decrease the amount Kry/Tenor would have to pay out even if 40% of owners took a tax loss. Everyone would get the same amount and have to deal with their personal tax returns accordingly.

I guess the only thing that really matters is that VZ will be forced to pay Kry and Kry will be forced to pay shareholders fairly to get the money released from Judge Silversteins court.
