CLF has agreed to this year's in-fill program at BD (it was held at a lawyers office lol). There is a legal process that CLF have to do in order to take out the minority SPQ holders (KWG is one) and there are required lead times that could push the meeting date to around the 43-101 date. Can you see the holdem poker here... wait too long to call the meeting and the new 43-101 could be out. CLF becomes the operator next April and could try to outspend KWG but KWG is confidend that they can maintain their 30%.
Another thing to remember is that KWG will own the CCC railway feasability study and is under no obligation to give it to CLF. They can in fact work directly with someone like CN to open up the rail.
